 This consent will be signed in person, so arrive at least 10 minutes early to fill out any additional paperwork. :)

     Guest Consent

The following provisions apply to the services to be performed for you. This is an agreement between you, hereafter referred to as Guest, and , By Her Hands Atelier & Spa.  Please read this completely:

DISCLOSURE: This treatment is a process and subsequent visits may be necessary in order to achieve the desired results. Subsequent visits are subject to additional charges per visit which depend on the amount of work needed. Actual results vary from person to person and By Her Hands Atelier does not guarantee any specific result. Possible allergies may occur resulting in skin breakouts, rash, redness and/or swelling.

SERVICES TO BE PROVIDED: This office provides Facials, Waxing, Sugaring, Full Body Relaxation, Scalp Exfoliation, Beard Enrichment, Back Facials, Sauna Detox Wraps, Vajacials, Manual Lymphatic Drainage, Dermaplaning, Microdermabrasion, Chemical Peels, Lash/Eyebrow Tinting and Lamination.

PAYMENT: Payment in full is to be made prior to the start of any service.

LATE POLICY: Client has a 10 minute grace period. After 15 minutes the appointment will be marked a a no-show as to prevent from interfering with next client. Client may reschedule once with a $25 additional payment.

AFTER CARE: After care instructions must be followed explicitly, whether given in writing or orally. Failure to follow after care instructions may compromise the final results of the treatment.

TERMINATION: The Guest may discontinue care and terminate this agreement at any time by written notice to the effect that it is delivered in person or by mail to the office. Such "notice of termination" shall discharge the office from all further obligations and/or duty to render care to the Guest. The office reserves the right to terminate this agreement in its sole discretion notwithstanding any other terms or provisions of this agreement.

NO REFUNDS IN THE EVENT THE GUEST TERMINATES AGREEMENT: To encourage commitment and follow-through, the services provider offers NO REFUNDS. No refunds will be made on any services performed. There will be no exceptions. The prepaid program cannot be altered, shared, or transferred. In addition, it cannot be combined with any other program.

GIFT CARDS: Gift cards are non refundable, non transferable and non exchangeable for cash and will not be replaced if lost or stolen. All gift card purchases are FINAL SALE.

NO GUARANTEED RESULTS: Guest recognizes and understands that neither office personnel nor this agreement provides a guarantee of results. The office makes no guarantee of the extent of longevity of improvement to be expected. This agreement deals solely with the services to be rendered and the fees to be paid for the care as provided. The Guest's payment obligation is not contingent upon the outcome of services. Guest's results can be hindered and/or suppressed by the consumption of the following, but are not limited to, different skincare products, allergies, alcohol, processed food, including but not limited to, sugar-based foods and drinks, the environment/pollutants etc. It is recommended that you consult your physician/dermatologist if you have any questions or concerns.

TIME LIMITATION FOR SERVICES: Guest understands that unused visits will expire if not used within 120 days from the date Guest starts the treatment unless the office has been provided with advance notice in writing of leave of absence or other valid cause of delay. After 24 weeks, all outstanding services/visits will be void.

RELEASE OF LIABILITY: Guest agrees to indemnify, hold harmless and release the service provider, its agents employees, officers, directors, representatives, assigns, members, affiliated organizations, insurers, and others acting on By Her Hands Atelier's behalf, of all claims, demands, causes of action, and legal liability, whether the same be known or unknown, anticipated or unanticipated and further agrees that except in the event of By Her Hands Atelier's gross negligence or willful and wanton misconduct, no claims, demands, legal actions and causes of action, shall be made against By Her Hands Atelier for any economic and non-economic losses of any kind.

ARBITRATION: It is understood that any dispute arising as to malpractice of treatment shall be decided by a neutral arbitrator. Any arbitration proceeding will be governed by Alabama's arbitrations statute, the fees for the arbitrator will be split pro-rata among the parties and each party will be responsible for their own attorneys' fees and costs. Any action to collect fees from the Guest/patient for the treatments performed may be brought in any court located in the State of Alabama and the prevailing party in such collection action shall be entitled to recover its reasonable attorneys' fees and costs. Filing of any action in any court to collect any fee from the Guest/patient shall not waive the right to compel arbitration of any malpractice claim.

GOVERNING LAW: This agreement shall be governed, construed, and interpreted by, through and under the Laws of the STATE OF ALABAMA.

COMPLETE AGREEMENT: This agreement constitutes the complete agreement and understanding between the Guest and By Her Hands Atelier and will not be changed or modified in any way unless agreed to by both parties in writing.

TERMS OF ACCEPTANCE/INFORMED CONSENT: When a Guest seeks Services and when By Her Hands Atelier/service provider accepts the Guest, it is essential that both are seeking and working with the same goals. We expect our Guests to take full responsibility for their decisions to participate in any of the services/programs offered by this office. We do not identify or diagnose any condition(s) or disease(s). We offer no treatment for any condition(s) or disease(s). We promise no cure for any condition(s) or disease(s).We have one goal: TO OPTIMIZE RELAXATION, help on your journey to healthy skin and to restore, maintain and promote overall wellness.

It is essential that you speak to your doctor prior to making any decisions about altering any medical regimen you are currently following, changing your diets, taking supplements, or going on an exercise and/or weight loss program. Getting your doctor's approval prior to starting any service/program at our office is critical and solely your responsibility. Should any health condition arise while you are a Guest, we recommend that you immediately see the appropriate health care provider.

Any options that are rendered by the staff should never be construed as medical advice but merely as opinions.

You understand and voluntarily accept these risks and agree that neither By Her Hands Atelier, service provider, staff, or any of its partners are liable for any injury to you, including, but not limited to, personal bodily injury, death, mental injury, economic loss or any damage to you, your spouse, or relatives resulting from any act of the service provider, and its staff or anyone else using the facilities and that you acknowledge the inherent risks of the positions, movements, skincare programs offered to and done to you at the service providers, with respect to your current and past condition (s). If there is any dispute between you and/or any of its staff, both parties agree to submit it to binding arbitration. We both agree to have a neutral arbitrator preside over any such dispute, not a judge or jury.

CONSULTATIONS: 5–10-minute consultation will be done at the beginning of every service. This time is included in your scheduled service session.

CANCELLATION POLICY:

  • After your appointment is booked you are only able to reschedule once.

  • A valid debit/credit card is required for all appointments.

  • All sessions/packages MUST be paid in FULL prior to your confirmed appointment.

  • Payments are non-refundable & purchased sessions cannot be transferred to another person.

  • Please do not forget to confirm your appointment when you receive your reminder from By Her Hands Atelier.

  • In the event of cancellations received less than 24 hours prior to appointment Tues-Fri, a cancellation fee equal to 50% of the reserved service booking will incur; Saturday cancellations require 48-hour notice.

  • No Shows will be charged 100%

 

By signing this agreement, I confirm that I am over the age of 18, I understand, and I certify that I have read the above paragraphs, had the procedure and risks explained to me, fully understand this consent and procedure form and herby consent to the indicated procedure(s). This means that I accept full responsibility for these and/or any other complications which may arise or result during or following the service I receive at By Her Hands Atelier which is to be performed at my request according to this agreement and I hereby agree to arbitration of any malpractice claim. I further understand that by signing this agreement, I surrender certain legal rights.

Please Note: It is very important to be on time for your appointment. Appointments are booked back to back and if you are late, you are cutting into the next person’s time. If you are late, the amount of time will be deducted from your session up to 10 minutes. After 15 minutes the appointment will be cancelled.
